1. Acceptance
By using bettergolftee.com or placing a reservation or order with us, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the site. These Terms form a binding contract between you and Ocean Edgewater LLC.
2. Who we are
"We," "us," and "Better Golf Tee" mean Ocean Edgewater LLC, a California limited liability company with a principal place of business in Los Angeles, California. "You" means the person using the site, placing a reservation, or buying a product.
3. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction (whichever is older), to place an order. You represent that the information you submit (email, name, shipping address) is accurate and yours.
4. The product right now: R&D
As of the Effective Date, Better Golf Tee is in research and development. There is no live commerce; the buy button is disabled. The "reservation" you can submit is an expression of interest only. No payment is processed; no contract of sale is formed by a reservation. We may decline any reservation for any lawful reason.
5. Pre-orders, if and when they open
If and when we open pre-orders, additional terms specific to those pre-orders will appear on the checkout page and supersede or supplement these Terms for that transaction. Pre-order payments will be processed via Stripe. By placing a pre-order, you will authorize Ocean Edgewater LLC to charge the payment method you provide.
6. Pricing
All prices, when posted, are in United States dollars and exclusive of any applicable sales tax or shipping. We may change prices at any time before you submit an order. We honor the price displayed at the moment your order is accepted, except in cases of obvious error.
7. Shipping
When we ship, we currently anticipate shipping only within the United States, via USPS Ground Advantage or comparable carrier. International shipping is not currently offered. Shipping risk transfers to you when the carrier accepts the package.
8. Returns, refunds, and cancellations
Our returns policy is at /returns/ and is incorporated by reference. In summary: 30 days from receipt, defective products replaced free, pre-orders cancellable until ship.
9. Acceptable use
Do not (a) reverse-engineer or scrape the site at scale, (b) submit false or misleading personal information, (c) use the site to harass, defraud, or harm others, or (d) attempt to defeat our security or rate limits. We may suspend or terminate access without notice for violations.
10. Intellectual property
The "Better Golf Tee" name, the bettergolftee.com site design, the line-art tee mark, the photographic and editorial content, the CAD geometry, and the underlying product design are owned by Ocean Edgewater LLC or licensed to us. Library of Congress and NASA photographs we display are in the public domain; everything else is ours. You may share article links, quote brief passages with attribution, and embed our Open Graph share cards in social posts. Do not copy our designs, mark, or content for commercial use without written permission.
11. User-generated content
If in the future we accept reviews, comments, photographs, or other user-submitted content, you grant Ocean Edgewater LLC a worldwide, royalty-free, perpetual license to use, reproduce, and display that content in connection with our product and marketing. You retain ownership.
12. Disclaimers
The site and product are provided "as is" and "as available." We disclaim all implied warranties to the maximum extent allowed by law, including merchantability, fitness for a particular purpose, and non-infringement. Golf is a sport played with hard objects swung at high speed. Use any tee at your own risk. We make no warranty that our product will improve your game, your launch numbers, or your handicap.
13. Limitation of liability
To the maximum extent permitted by law, Ocean Edgewater LLC's total cumulative liability arising from these Terms, your use of the site, or any product we sell to you, will not exceed (a) the amount you paid us in the 12 months before the claim, or (b) one hundred US dollars ($100), whichever is greater. We are not liable for indirect, incidental, consequential, punitive, or special damages, even if advised of the possibility.
14. Indemnification
You agree to defend, indemnify, and hold harmless Ocean Edgewater LLC and its members, employees, and agents from any claim, demand, or damages arising from (a) your use of the site or product in violation of these Terms, (b) your violation of any law, or (c) your violation of any third-party right.
15. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
16. Dispute resolution
Informal first. Before filing any formal claim, contact us at contact@bettergolftee.com and describe the issue. We agree to negotiate in good faith for at least 30 days before either party files a formal proceeding.
Binding arbitration. Any claim not resolved informally will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Los Angeles County, California. Arbitration is conducted by a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.
Small-claims exception. Either party may bring a claim in small-claims court if the claim is within the court's jurisdictional limits.
Class action waiver. You and we agree that all claims must be brought individually, not as a member of a class, consolidated action, or representative proceeding.
30-day opt-out. If you do not want to be bound by the arbitration agreement, email us at [email protected] within 30 days of first accepting these Terms with the subject line "Arbitration Opt-Out." Opting out does not affect any other portion of these Terms.
17. Force majeure
We are not liable for failures or delays caused by events beyond our reasonable control, including acts of God, pandemics, supply chain disruption, postal-service interruption, government action, or printer hardware failure (we are a small operation; our Bambu P1S is the bottleneck and it sometimes needs maintenance).
18. Severability
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.
19. Entire agreement
These Terms, together with our Privacy Policy and Returns Policy, are the entire agreement between you and us regarding the site and product.
20. Changes
We may update these Terms. The Last Updated date at the top of this page reflects the most recent revision. Material changes will be posted on the home page for at least 30 days.
